I'm going to lay off the law talk since I imagine it's boring to most folks. Suffice to say if you read that case close enough you'll see the general rule gives you no shot.
I'll also add that I think the Oaks is foul cesspool full of degenerates and angle shooters. I understand that poker players have poor hygiene, but I draw the line at smelling like you peed yourself. I'm not at all surprised that this type of incident happened there. Before I left Oakland I much preferred taking a few more minutes to go to Casino San Pablo---just as fishy and no urine smell.
