How could he flip a 6h with one on the board?

Assuming it was something else... he went all in with Q high? Or a pair of sixes, assuming a different suit?

I dunno... I think its an easy call.

The only thing really controlled by the feds when it comes to gambling is whether or not taxes are paid on winnings. I don't think there's a federal statute against gambling.
