assault with a silent but deadly waepon
 
is it illegal to fart in someones face?
can i go up to a cop and fart right in front of him and waft it in his face and get away with it? can you assault someone like that without touching them or saying anything?

They would probably just charge you with mischief or throw you in the drunk tank for the night.

I dont know about the particular situation, but you can assaut someone without touching them. I'm too lazy to find a reference, but I'm sure someone will.

Assault is harming someone or causing them to believe you will harm them or something like that. For the later, touching is not neccesary.

Battery, by definition, has to involve physical contact.

i know it would be -EV to fart in a cops face, because he would mace me...but would the charge mischeif hold up in court?...my lawyer would have to take the "whoever smelt it dealt it" defense, while the prosecution would use " whoever denied it supplied it ." what is supreme court nominee john roberts' stance on this issue?
