Here is the lie of the latest Republican Talking Point
 
Here is the Federal Statute that would apply:

R.S.5298 provides, "Whenever by reason of unlawful obstructions, combinations or assemblages of persons, or rebellion against the authority of the United States, it shall become impracticable, in the JUDGMENT OF THE PRESIDENT, to enforce, by the ordinary laws of judicial procedure, the laws of the United States within any State or Territory, it shall be lawful for the President . to employ such part of the land and naval forces of the United States as he may deem necessary to enforce the lawful execution of the laws of the United States ."

So based on the JUDGEMENT OF THE PRESIDENT (this is kind of shakey since we are talking about Chimpy), Federal troops can be sent in for the exact situation we saw in New Orleans, without permission from anyone in the State.

There are provisions for the Legislature (or the Executive, if the Legislature is unavailable) of a State, to request Federal Troops, but it is not a requirement when the conditions of the above are met.

You still don't get it. It is a last resort to force ourselves upon a state government, the people of the state elected that state government and have a right to use it. When the state needs help they ask.

Is is presumed that the state government is competent and will enlist federal assistance as needed without the President having to push the governor aside.

Do you think Eisenhower sent the guard to Central High School without first asking Gov. Faubus to cooperate? It was a last resort and was not done lightly. The same principle applies here.

Since the Civil War we have known that in a pinch the feds can supercede the state government. You are telling us nothing new. But we don't routinely ignore the states, which I would think would be obvious to you also.

Now we know that Gov. Blanco is not up to the job. We will keep this is mind for the future.

So when the Mayor of New Orleans was on the radio begging and pleading for help from the federal government (and, I might add, given the President a well-deserved cussing out and ass-chewing) does that qualify as "asking?"

Or, should the Mayor have gotten down on his knees and said, "Oh massah, won't you please come help us massah?"

Its an excuse for inaction that does not hold water. National guard units from Arkansas and elsewhere were there on the first day, because they did not pretend that they were unable to act without redtape.

These governors dropped the ball and are trying to deflect blame. Note that Gov. Richardson in a Democrat with national ambitions.

The mayor of NO had already made his catastrophic mistakes at that point, and he was in cover-my-ass mode. Balming the Feds and claiming racism are proven effective techniques for diverting attention from your mistakes.
