Yes, but my personal favorite was when a picture of a xbox or ps2 was sold on ebay. It said something like, "You will recieve what is in this photo" and it was a photo of a phote of a xbox/ps2.

I was a semi-pro eBay seller for a few years, and from what I can tell the auction is legit, and any state that recognizes eBay auctions as binding contracts (which most do now) would honor it. HOWEVER, including an inaccurate picture is a violation of eBay Terms of Service, even if you say "it looks nothing like the picture" which this seller did. eBay may then decide that it is an invalid auction and remove it from their (public) servers, then it would not be valid.

I think we just had a thread with a link to an auction that sold an email address like [email protected] or something similar. The text clearly stated that you weren't getting an xbox360--you were getting the password to a yahoo email address, which you could use as your own.

Since the auction ran the same day the XBox was released, he got about 100 bids, that ran up $800.

I suspect a lot of the bids are people simply BIDDING because they want one. Once they actually WIN it, they read it and find out it was bogus, and just never pay up.

Another guess is that some of the bidders don't know english very well, which is very possible.

it seems like he could get away with just selling the box since he mentions in his listing that it's just the box, but in the middle of the listing it says it's xbox dvd rom or some [censored].

2. It is NOT obvious that he wasn't trying to rip them off just because he is refunding the money. He might have had every intention of ripping someone off before a) changing his mind, or b) realizing EBay wouldn't allow the sale.

This guy should make a deal with the mother. To get the money back she has to send a signed hand written apology to him. The apology should be required to spell out the entire story.

He should then sell the apology over ebay.

Selling a box on eBay with a reserve of over $500 isn't trying to rip someone off? He knew what he was doing and was just being a turd in general...the fact that he came to his senses afterwards and realized he's a turd just goes to show it.

I don't think its fair to jump to conclusions about the guy who ran the auction. It appears to me that he set this all up as some sort of experiement. He has the screenshots and e mails. For all we know this could have been a project or study for some sort of Economics class or other such [censored].
