Rehnquist is expected. Everybody is ready for that.

But, Stevens is sort of a surprise, isn't it? I know he's very old (85?). But, I thought everybody was expecting him to try to get through the Bush second term and hope for a Democrat to get elected in 2008.

especially with O'Connor retiring, things could get very interesting. THe fact that the democrats can filibuster any Bush choice that they don't like could very well grind the Supreme Court to a halt for the rest of Bush's term

I think the Republican members who signed that compromise filibuster agreement have made it abundantly clear that they aren't going to allow the Democrats to filibuster Supreme Court nominees just because they don't like them.

The SCOTUS can operate with only 8 or 7 or 6 members if they want, no problem (they might have the occasional tie vote, but they don't have to be at full membership to proceed).

Drudge is now reporting Rehnquist will announce tonight.

Stevens appears to just be dogs humping, as he is hiring clerks for the upcoming term.

A little known fact about Stevens:

He grew up as a Republican, his father was a Republican politician. He has stated in the past that he wants to replaced by a Republican President. We may think of him as on the liberal side of the court, but like Whizzer White on the Democratic side, Stevens has taken his party affiliation seriously. So he may very well screw the country by giving the Boy King another seat on the court. [img]/images/graemlins/frown.gif[/img]

I hope the justices do retire together rather than spreading the retirements out because it'll be harder for the Reps to get multiple conservatives this way. I'm sure some self-righteous poster will dispute this fact in a knee-jerk fashion, but the Washington Republicans are openly worried about it.

Why would it be harder?

Either the GOP has the votes and the commitment to apply the nuclear option or they don't. If they have enough votes to get one nominee through, they have enough for 2 or 3 nominees.
