it seems like he could get away with just selling the box since he mentions in his listing that it's just the box, but in the middle of the listing it says it's xbox dvd rom or some [censored].

Incorrect ones aren't, and you are clearly in the wrong here. He was obviously NOT trying to rip someone off since he is refuding the money. I'll bet the buyer is a lot more careful from here on out, and much better off for it.
