The truth is that they accepted a bonus code and then furthermore sent out an e-mail confirming their acceptance of the bonus

if you were incorrectly pushed a pot that you lost because a dumbass programmer made a mistake would this be a breach of contract? i'm not trolling, i am asking seriously since you are a law student. in this scenario, you had the worst hand, and it was awarded to you incorrectly due to a coding error.

from what i see, this is simply a malfunction. voiding malfunctions is clearly covered in the terms you accepted when signing up.

Exactly. It's not like someone sat down and typed up the confirmation e-mail either. That stuff is completely automated (along with some of the support e-mails too I think). Heck, when I withdraw money from Empire or Party, I get two confirmation e-mails within a split second of my withdrawl.

This is a legitimate point. Nevertheless, if it wasn't meant for me or anyone else then they should have a way of blocking those who it isn't meant for. Oh wait, they do. People try bonuses all the time and get blocked.

They screwed up, but they can hide behind their terms and conditions, especially since it isn't worth the money involved to go get your $500.

Thanks for bringing up the terms and conditions.

Granny and Nolan,

Automation usually isn't an answer to a contract question. I indicated my willingness to accept the bonus and they literally acquiesced in writing.

I think getting pushed a pot is different, since you aren't entering into a written agreement to play X number of hands for X amount of bonus. Plus, there is an implied agreement during a game to play by the rules of the game. Getting pushed a pot with a losing hand violates the rules of poker.

Yuck, talking about law on a poker forum. I play poker as a break from law school. [img]/images/graemlins/smile.gif[/img]

Anyway, nothing here is hard and fast, I'm just a student (at a top 5 law school though) and it's just my opinion.

Since you said top 5 instead of top 4, do you go to NYU?

Come on dude, I don't have to be in law school to know that when you accept the terms and conditions agreement, they can do whatever the heck they want with their bonuses. Whether or not you entered a "contract" is irrelevant.

Nolanfan,

On a non-legal basis, I would hope they can't do whatever they want with their bonuses. I have cleared some before at Empire and my bonus was always released after completing the requirements of the bonus.

I hope they can't just do whatever they want to do, although it looks like you are right on this one. Oh well, like I said earlier, they lost my business.

I hear what you're saying. I don't think they act with malice intentionally. But as Grannie pointed out a few days ago, this clearly wasn't a code meant for the general public, which of course has become clear since then, and according to their T&C they are well within their rights to correct the error they made.

I don't understand how anyone could see it different.

If people have gripes about not being eligible for the full 10% September bonus though, I do think they're being unfair there by not allowing people to qualify for the full amount, if people want to clear the necessary number of hands required.

Frankly, I'm a little relieved about the whole thing, because I hate Empire and Party's software, and can now go work on my Stars bonus (and get ready for KOTZ!) instead.
