After some research I found that Dragon Networks, Inc. (www.dragon.com) is the host of WinHoldEm. After looking at their Acceptable Use Policy and Terms of Service (http://www.dragon.com/aup.html), I have taken the liberty of informing them exactly who their client is and the practices they employ.

I urge you to send mail to abuse@dragon.com or call them directly at 770.458.1350. Here is the relavent information for your call/email:

If we all take the time to bring to their attention who their client is and the activity their program enables we may see results. While I am under no dillusion that this would permanently stop them, I believe it is a start.

Good grief.

Look, WinHoldem-boy might be annoying as all get out, but as far as I can tell, "pissing off jamescam" doesn't appear to violate the Terms of Service at Dragon.

Besides, I want to see as many people as possible load up and use WinHoldem! Talk about easy money!

limited to, intellectual property, communications, privacy, criminal and
international law);" He proudly claimed that his Bots can play perfect
poker at Party Poker & Poker Stars but Bots violate those sites regulations.

"Activities which adversely affect the ability of other people or systems to
use Dragon Networks services or the Internet;" Providing collusion software
effects use.

"Using the Service in an attempt to break security" This one applies but not
for the reason you may think, he has altered the code of his software to
allow a work around of Party Poker's security so that a bot can be ran
without detection.

Perhaps, but he still isn't breaking the law by hawking this software. The only thing he's doing is making an ass of himself. Unfortunately, being a complete nipplehead isn't against the law.

No, it doesn't. It effects the Internet very little and Dragon Systems not at all. Unless you count all the extra IM traffic that's generated by the constant "my hole cards are XxXx, what's yours" traffic that's clogging up the Internet due to this software and slowing the spread of the SoBig virus.

Two holes in this theory. First, he's not using Dragon's resources to crack another system's security, he's using it to advertise a software product. Second, I would imagine that if you had evidence to support the claim that WinHoldem bypasses a poker sites security measures, you would have reported it by now. Lack of a cease and desist order to our friend at WinHoldem makes me think perhaps your case isn't quite that airtight.

If you're going to spend resources on your personal vendetta against this small-time spam jester, might I suggest not banging your head against his Internet provider. If you really think WinHoldem is to online poker players what communists are to McCarthy, I think you're energy is better served barking at the Party Poker folks!
