According to my contracts professor, this is a legally binding contract that some stupid kid is very lucky to get out of.

$550 for the box only. Read it right there.

Can you really get away with that?

Ebay won ban you or anything?

Wayfare

They may ban you, but you can take your $550 and buy a lot of tissues.

i initally thought this guy was a huge [censored] for doing this then read the idiotic mothers response about "contacting the authorities" and suddenly love this guy for doing it. it would be even better if he didnt give the money back (if this is possible) now

Yes, but my personal favorite was when a picture of a xbox or ps2 was sold on ebay. It said something like, "You will recieve what is in this photo" and it was a photo of a phote of a xbox/ps2.

I was just thinking about this the other day -- there are stupid people EVERYWHERE that you look. Just look around you, I bet you see one or two right now!

Part 1 - go to their state and try to sue them. Good luck on making it worth while for the $
Part 2 - yes

I was a semi-pro eBay seller for a few years, and from what I can tell the auction is legit, and any state that recognizes eBay auctions as binding contracts (which most do now) would honor it. HOWEVER, including an inaccurate picture is a violation of eBay Terms of Service, even if you say "it looks nothing like the picture" which this seller did. eBay may then decide that it is an invalid auction and remove it from their (public) servers, then it would not be valid.

I think we just had a thread with a link to an auction that sold an email address like xbox360@yahoo.com or something similar. The text clearly stated that you weren't getting an xbox360--you were getting the password to a yahoo email address, which you could use as your own.

Since the auction ran the same day the XBox was released, he got about 100 bids, that ran up $800.

I suspect a lot of the bids are people simply BIDDING because they want one. Once they actually WIN it, they read it and find out it was bogus, and just never pay up.

Another guess is that some of the bidders don't know english very well, which is very possible.

that's pretty sad, but funny.

it seems like he could get away with just selling the box since he mentions in his listing that it's just the box, but in the middle of the listing it says it's xbox dvd rom or some [censored].

This is why I stopped buying [censored] from eBay. Everyone is trying to rip everyone else off from a safe distance.

What a smelly cvnt that guy is. Granted, the kid shoulda read the description better, but that guy was obviously just trying to rip someone off.

Which is why he's refunding the money, right? Jesus Christ you're dense.

12-01-2005, 12:19 PM
I think the guy taught these people a good lesson. Maybe they won't be as dumb in the future. I think everyone benefits. Just like the old saying
"fool me once, shame on — shame on you. Fool me — you can't get fooled again" -GW

vex,

Incorrect ones aren't, and you are clearly in the wrong here. He was obviously NOT trying to rip someone off since he is refuding the money. I'll bet the buyer is a lot more careful from here on out, and much better off for it.

1. This guy is a douche.
2. It is NOT obvious that he wasn't trying to rip them off just because he is refunding the money. He might have had every intention of ripping someone off before a) changing his mind, or b) realizing EBay wouldn't allow the sale.
3. People should read the product description more carefully, and this woman should be happy she is getting her money back without much hassle.
4. This guy is a douche.

This guy should make a deal with the mother. To get the money back she has to send a signed hand written apology to him. The apology should be required to spell out the entire story.

He should then sell the apology over ebay.

That would be classic.

Selling a box on eBay with a reserve of over $500 isn't trying to rip someone off? He knew what he was doing and was just being a turd in general...the fact that he came to his senses afterwards and realized he's a turd just goes to show it.

I don't think its fair to jump to conclusions about the guy who ran the auction. It appears to me that he set this all up as some sort of experiement. He has the screenshots and e mails. For all we know this could have been a project or study for some sort of Economics class or other such [censored].

I'll be the voice of dissent and say I applaud guys like this. Profiting off of ignorance is the American way. We have no problem doing it in certain, shall-remain-nameless games. Caveat emptor.
