not political - more commentary - so posting here...

what surprised me so much about the headline is it sort of implies that before this law, it wasn't illegal -

sorta makes me wonder what the hell they're doing if they can't prosecute them under current fraud and theft laws.

Although this now makes it a crime to even try....whereas before, it might be hard to charge for fraud and theft if they sent out emails and didn't get a response.

Of course, the vast majority of perps are outside the US...so I don't see the California courts filling up anytime soon.

It was already against the law to do phishing, but it was only a criminal offense. So the people would go to jail (ok well probably do some community service). But the point is only criminal charges could be brought. This new law allows civil remedies against the offenders and thus money damages can be awarded. So it just added a civil offense. It has been a criminal offense for a while and still is.
