more important is what the supreme court will look like.

what happens if rehnquist dies during the lame-bush period? please don't tell me bush gets any say.

I'm not 100% sure of the legal requirements, but I wouldn't be surprised if he were able to make an appointment and try to rush it through the Senate. But the Dems might dig in their heels and filibuster until time runs out.

I don't believe that the senate is in session.
As i understand it Bush can appoint a provisional justice if the senante is out of session that can last as long as 2 years. Then it would be up to the current pres to appoint a permanent one.
