At the very least i would like to see this change in the EC. If no candidate gets the requisite 270 votes then the winner is decided by the popular vote as opposed to the house.

Interesting idea, but I think that would still lead to the same problems as just using the popular vote in the first place. Added to that, what about the people who voted for 3rd party candidate X, but would've voted for Kerry or Bush if they only had those two to choose from? On the other hand, the voters were already allowed to choose their representatives, and these reps are supposed to speak for their constituents. If the people aren't happy with who their rep choses, they can voter him/her out.

You will need a 2/3 majority of both houses of Congress followed by ratification by a minimum of 38 state legislatures to accomplish this.
